Petition to Immediately Discontinue “Bharat Nirmaan” Advertisements!

New Delhi, India

Subject: Petition to IMMEDIATELY discontinue - 2 “Bharat Nirmaan” advertisements.

Hon’able Dr. Singh,
That you are man of high personal integrity is a fact beyond any doubt. It was this personal integrity that has taken you to achieve great heights and take up positions of responsibility in the past.
You have also been selected to represent the 1.2 billion headcount, which by any standards is a humungous feat.
Being the Prime Minister of the Republic of India, we, the nation have always looked up to your Chair and wish that you give us the opportunity to continue doing the same in the future.
As you are aware, the General Elections of 2014 are round the corner. And all political parties have started going hammer and tongs publicising their achievements in order to garner maximum votes.
I believe, the same strategy has been adopted by the UPA and more so by the Congress.
However, I, as a citizen of the Republic of India would like to humbly and most respectfully put forth certain queries. I would be obliged if you could personally look into my reservations and could respond to my letter at the earliest since your response will directly affect the lives of the said 1.2 billion potential voters.
I would like to bring to your notice the following:-
1) It has been observed that the Bharat Nirmaan Campaign of the Congress Party has started doing rounds in all the households thru the medium of Television Advertisements.
2) It has also been observed that till date, the Bharat Nirmaan Campaign of the Congress Party, has been delivered in 3-4 phases.
3) The Bharat Nirmaan Campaign adopted by the Congress Party has its central theme revolving around the various beneficiary programmes doled out for the public.
4) Whereas it is noticed that One such theme revolves around the Food Security Bill, it is observed that the other 2 themes harp on the 2 bills introduced in the Parliament a) The Hawkers Regularisation Bill.
b) The Real Estate Regularisation Bill.
The 2 above mentioned bills still waiting in line to get the required approval from the august members of the Upper House and is also waiting to be converted into an “Act.”
5) Whereas the ASCI (Advertising Standard Council of India) and the ECI (Election Commission of India) allows any political party to publicise its efforts which have only been converted into “Acts”, the same does not and should not allow any political party to publicise efforts / Bills that are yet to be “passed” by either House and converted into an “Act”
6) All this just to enable a particular political party to take credit of the law which it “intends” to pass, thereby trying to capitalize on the emotions of the voters.

Respected Dr. Singh, I seek your pardon to bluntly term these actions of your Congress party a mere vote grabbing technique which has its premise built on
a) Misrepresentation of Facts
b) Fraud
c) Concealment of Facts
I am sure that an extremely knowledgeable person like yourself would be aware of the Sections 107, 405, 409, 418 and 420 of the IPC which can be evoked out of such gross misrepresentation.
The elements of such advertisements include:
· Material false statement;
· Knowledge of its falsity;
· Reliance on the false statement by the victim;
· (A loss) Damages suffered;
· A deceit or fraud constituting a false statement made wilfully or recklessly, which causes loss to another.
Knowing well, the ill effects of the Bharat Nirmaan advertisements aired by the Congress, I am sure a responsible individual of your stature will immediately take the necessary corrective measures and take the said Bharat Nirmaan advertisements off air.
